Golf with Stars – Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the Golf with Stars platform. By creating an account or using the platform, you agree to be bound by these Terms.

Golf with Stars Pty Ltd operates an Australian marketplace platform connecting users with participating celebrity, athlete, creator, and professional talent for golf experiences.

Nothing in these Terms excludes, restricts, or modifies any rights or obligations that cannot be excluded, restricted, or modified under applicable law.

1. Platform Role

Marketplace Platform: Golf with Stars provides an online marketplace where Users can browse Star profiles and request golf experiences. Golf with Stars does not own, operate, manage, or control any golf course, venue, facility, or physical location where a golf experience takes place.

Independent Providers: Stars are independent third-party service providers and are not employees, agents, partners, representatives, or contractors of Golf with Stars.

2. Account Eligibility and Accuracy

You must provide accurate, current, and complete information when creating or maintaining your account.

You are responsible for maintaining the confidentiality of your login credentials and for all activity occurring under your account.

Golf with Stars may restrict, suspend, or terminate your account if we reasonably believe you have provided false information, breached these Terms, misused the platform, created a safety risk, or acted unlawfully.

3. Booking Requests

A booking request is an invitation for the selected Star to review and either accept or decline your proposed golf experience.

Submitting a booking request does not guarantee acceptance.

A booking only becomes confirmed after the Star accepts the request and Golf with Stars confirms the booking within the app.

4. Payment Authorisations

Authorisation Hold: When you submit a booking request, your payment method may be authorised for the booking amount where authorisation is available and successfully processed. This reserves the funds but does not complete the payment.

Capture or Release: If the Star accepts your booking request, the authorised payment may be captured, subject to the authorisation remaining valid and successful payment processing. If the Star declines the request, the request expires, or the booking cannot proceed before acceptance, Golf with Stars will cancel or release the authorisation where possible.

Processing Times: Depending on your financial institution, released authorisations or refunds may take several business days to appear.

Third-Party Payments: Payments are processed through third-party payment providers. Additional terms, verification requirements, and banking rules may apply.

5. Golf Course Bookings and Venue Costs

User Responsibility: Unless expressly stated otherwise before booking, the User is responsible for arranging and securing the tee time directly with the golf course or venue. The Golf with Stars booking fee covers only the Star’s attendance and the platform service.

Venue Expenses: The User is responsible for all venue-related costs, including green fees, cart hire, caddie fees, food and beverages, and any other charges for both the User and the Star unless otherwise agreed through the Golf with Stars app before the round.

Failure to Secure a Tee Time: If a confirmed booking cannot proceed because the User fails to arrange a valid tee time or required venue access, the booking may be treated as a User No-Show under the Booking Cancellation Policy and may not qualify for a refund except where required by law.

6. Cancellations, Refunds, No-Shows, and Disputes

Booking cancellations, refunds, no-shows, weather events, course closures, and disputes are governed by the separate Golf with Stars Booking Cancellation Policy.

By using the platform or submitting a booking request, you agree to that policy.

7. Respectful Conduct

You must treat Stars, Users, Golf with Stars staff, golf course staff, and venue staff respectfully.

Harassment, threats, discrimination, intimidation, stalking, abusive behaviour, unwanted physical contact, or unlawful conduct are strictly prohibited.

You must not attend a booking while excessively intoxicated or under the influence of substances in a manner that creates a safety risk or prevents the booking from reasonably proceeding.

Golf with Stars may cancel bookings, suspend accounts, restrict platform access, or remove content where we reasonably believe these Terms have been breached or marketplace safety has been compromised.

8. Identity and Safety Verification

Golf with Stars or its payment providers may require identity verification, payment verification, or additional information before allowing bookings to proceed.

Failure to provide requested information may result in booking cancellation, account restrictions, or limited access to platform features.

9. Messages and Content

You must not send unlawful, abusive, threatening, discriminatory, fraudulent, misleading, sexually explicit, spam, or otherwise inappropriate content through the platform.

Golf with Stars may review, remove, restrict, or report content where reasonably necessary for platform safety, dispute resolution, customer support, fraud prevention, legal compliance, or enforcement of these Terms.

10. Off-Platform Bookings

You must not use Golf with Stars to identify, contact, or meet a Star and then arrange bookings, payments, or paid golf experiences outside the platform to avoid platform fees.

This restriction applies while you use the platform and for 24 months after your last interaction with that specific Star through Golf with Stars, to the extent permitted by law.

Attempts to circumvent the platform may result in booking cancellation, account suspension, permanent account termination, or other action permitted by law.

11. Physical Risk and Offline Interactions

Golf involves inherent physical risks including golf balls, clubs, golf carts, weather, slips, falls, and medical emergencies.

By participating in a golf experience, you acknowledge these risks and participate at your own risk.

Golf with Stars is not responsible for the operation, safety, maintenance, staff, rules, or conduct of any third-party golf course or venue.

To the maximum extent permitted by law, Golf with Stars is not liable for personal injury, property damage, medical emergencies, venue issues, or offline disputes except where caused directly by Golf with Stars’ own negligence, breach of law, or wilful misconduct.

12. Platform Availability

Golf with Stars may modify, improve, suspend, or discontinue parts of the platform at any time.

We do not guarantee uninterrupted availability or compatibility with every device, operating system, or region.

13. Account Deletion

You may request deletion of your account through the app.

Certain information may be retained where required or permitted by law for taxation, payment processing, fraud prevention, dispute resolution, legal obligations, or safety purposes.

14. Intellectual Property

All platform content, branding, trademarks, logos, graphics, software, designs, text, and other materials are owned by or licensed to Golf with Stars unless otherwise stated.

You may not reproduce, copy, modify, distribute, reverse engineer, or commercially exploit any part of the platform without prior written permission except where permitted by law.

15. Support and Disputes

For support regarding bookings, cancellations, refunds, payments, account access, safety concerns, or technical issues, please contact Golf with Stars through the app or via support@golfwithstars.com.

Before commencing formal legal proceedings, you agree to make a genuine and reasonable effort to resolve disputes directly with Golf with Stars where appropriate.

16. Force Majeure

Golf with Stars is not responsible for delays, cancellations, or inability to perform services resulting from events beyond reasonable control, including severe weather, natural disasters, government actions, pandemics, strikes, venue closures, or other unforeseen circumstances.

17. Governing Law

These Terms are governed by the laws of Queensland, Australia.

You and Golf with Stars submit to the non-exclusive jurisdiction of the courts of Queensland, Australia, subject to any rights or protections that cannot be excluded under applicable law.
